{"id":2283,"date":"2015-02-18T20:28:17","date_gmt":"2015-02-18T18:28:17","guid":{"rendered":"http:\/\/rechtsportlich.net\/?p=2283"},"modified":"2015-12-16T14:28:56","modified_gmt":"2015-12-16T12:28:56","slug":"lg-stuttgart-werbung-in-automatischer-antwortmail-ist-erlaubt-revision-zugelassen","status":"publish","type":"post","link":"http:\/\/rechtsportlich.net\/?p=2283","title":{"rendered":"LG Stuttgart: Werbung in automatischer Antwortmail ist erlaubt \u2013 Revision zugelassen"},"content":{"rendered":"<p><strong>Das LG Stuttgart hat in einem von uns vertretenen Fall (wir vertreten den Kl\u00e4ger\/Berufungsbeklagten) entschieden, dass Werbung innerhalb einer automatischen Antwort per E-Mail (Eingangsbest\u00e4tigung) an einen Verbraucher zul\u00e4ssig ist, weil sie den Empf\u00e4nger nicht erheblich bel\u00e4stigt (<a href=\"http:\/\/rechtsportlich.net\/wp-content\/uploads\/2015\/02\/neu_LGStuttgart.pdf\">LG Stuttgart, Urteil v. 4. Februar 2015, Az.: 4 S 165\/14<\/a>).<\/strong><\/p>\n<p>Dies auch, wenn:<\/p>\n<ul>\n<li>diesbez\u00fcglich keine Einwilligung vorliegt in den Erhalt von Werbung per E-Mail<\/li>\n<li>die Werbung vom Umfang her den Hauptteil (der Zeichen nach beurteilt) der E-Mail ausmacht<\/li>\n<li>der Empf\u00e4nger\/Verbraucher ausdr\u00fccklich der Werbung via E-Mail widersprochen hat<\/li>\n<li>die Ausnahmeregelung nach <a href=\"http:\/\/dejure.org\/gesetze\/UWG\/7.html\" target=\"_blank\" title=\"&sect; 7 UWG: Unzumutbare Bel&auml;stigungen\">\u00a7 7 Abs. 3 UWG<\/a> nicht greift<\/li>\n<li>es sich um ein zus\u00e4tzliches, nicht angefordertes und nicht notwendiges Schreiben handelt<\/li>\n<li>die E-Mails nicht auf die Anfrage des Empf\u00e4ngers eingehen und die Beklagte nicht verpflichtet ist, solche E-Mails zu versenden (wie z.B. bei manchen Transaktionsmails, bei denen man eine E-Mail also ohnehin erhalten m\u00fcsste)<\/li>\n<li>es sich nicht um eine Antwort auf die Anfrage handelt, und eine tats\u00e4chliche Antwort zu keiner Zeit jemals erfolgt ist<\/li>\n<\/ul>\n<p>Das LG Stuttgart hat damit das Urteil der ersten Instanz (AG Bad Cannstatt, Az.: <a href=\"http:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=10 C 225\/14\" target=\"_blank\" title=\"AG Stuttgart-Bad Cannstatt, 25.04.2014 - 10 C 225\/14: Unzul&auml;ssige Werbung in einer Autoreply-Ma...\">10 C 225\/14<\/a>) aufgehoben und anders entschieden. Allerdings hat die Berufungskammer die Revision zum BGH zugelassen, weil die streitgegenst\u00e4ndliche Frage nicht h\u00f6chstrichterlich gekl\u00e4rt sei.<\/p>\n<p>Unser Mandant hat bereits Revision beim Bundesgerichtshof in Karlsruhe einlegen lassen.
