Nationalism vs Globalism: Regional and Transnational Legal Issues Reshaping the Entertainment Industry.

Die International Association of Entertaiment Lawyers (IAEL) hat auch in diesem Jahr wieder ein Handbuch veröffentlicht. Die offizielle Vorstellung erfolgt am 15.7.2021 bei der Digital Midem. Ich freue mich sehr, dass ich auch in diesem Jahr wieder mit zwei Beiträgen („The Amended Audiovisual Media Services Directive“ und „Mandatory Vaccination
for concert visitors?) an einer erfolgreichen Veröffentlichung mitwirken durfte.

MIDEM 2020 – Digital Edition

The virtual IAEL (International Association of Entertainment Lawyers)  Legal Summit is proceeding as planed with the legal update and masterclass on June 3th, and the main session book Panel on June 4th. Both will beginn at 10 am (ET)/ 4 PM (CET). In a time of worldwide distancing an Isolation, the IAEL has come together to mount ist first-ever digital IAEL Legal Summit a part of Major music conference Midem.  In the annual Legal Update I will present to you the „sampling decision“ of the ECJ „Metall auf Metall“. MIDEM 2019 – Cannes: Legal Summit in association with the IAEL

At the Midem 2019 in Cannes the Legal Summit in Cooperation with the International Association of Entertainment Lawyers (IAEL) will took place on June 5th.  As a speaker I  represented the „Metall auf Metall“ case pending on the ECJ:

The Facts:

The two plaintifs are members of the musical group Kraftwerk, which released  in 1977, a phonogram containing the work entitled „Metall für Metal“l.  Defendant is the producer of a phonogram containing the work entitled “Nur mir“.  The Plaintifs claim that Defendant copied, using the sampling technique, approximately two seconds of a rhythm sequence from the song „Metall auf Metall“ and incorporated them, as a continuous loop, with minimal changes and recognisably, in the song „Nur mir“. Being of the view that this infringed the related right which they held as producers of the phonogram  Plaintifs requested, inter alia, the termination of the infringement, the award of damages and the surrender of the phonograms for the purposes of their destruction.

In those circumstances, the Bundesgerichtshof (Federal Court of Justice, Germany), hearing the case, referred a number of questions to the Court of Justice for a preliminary ruling concerning the interpretation of EU law on copyright and related rights, and fundamental rights.
In its Opinion, Advocate General notes, firstly, that a phonogram is a fixation of sounds which is protected, not by virtue of the arrangement of those sounds, but rather on account of the fixation itself. It is therefore protected as an indivisible whole. The reproduction of such a recording is therefore the exclusive right of the producer of that phonogram.
The Advocate General points out in that regard that producers can exploit phonograms in other ways than by selling copies, such as authorising sampling and generating income therefrom. Furthermore, he considers that the right to the protection of the phonogram is a right which exists and applies independently of the protection of the work possibly featured in that phonogram. Accordingly, the scope of protection of a phonogram is in no way subject to the scope of protection of the work that it may possibly contain. The need to obtain a licence for such use does not, restrict artistic freedom to an extent which goes beyond the usual constraints of the market, especially as these new works often generate substantial income for their authors and producers. For those reasons, Advocate concludes that sampling infringes the exclusive right of the producer of the first phonogram.(Get a license or do not sample.) The Advocate General shares the Federal Court of Justice view that sampling constitutes an infringement on the rights of the phonogram producer and, unlike the BVerfG, denies that artistic freedom takes precedence. Should the European Court of Justice follow the opinion of the Advocate General, this would, from the point of view of copyright law, mean the final end of sampling without the consent of the producer of the protected phonogram, which has been distributed for decades, and would significantly strengthen the rights of phonogram producers.

Finding the value in the gap

Das sogenannte Main-Seminar der International Association of Entertainment Lawyers  (IAEL) auf der MIDEM 2018 befasste sich mit der Frage ob in der Musikindustrie tatsächlich ein sogenannter Value Gap existiert. Neben Rechtsexperten aus verschiedenen Ländern war ich auch dieses Jahr wieder zur Podiumsdiskussion( ab Min. 10.55) eingeladen.

Copyright holders and performers see themselves at a disadvantage.It is postulated that in order to avoid this value gap liability privileges for content on hosting platforms with user generated content should be repealed and clarified by the legislature so that operators are directly liable under copyright law as perpetrators for content posted by users. At the present time in the music industry in particular, rights holders feel that they are not receiving adequate provision for the exploitation of their content on hosting platforms such as YouTube and Facebook, for example, in connection with an existing value gap. This will be dicussed today in Cannes at the IAEL Seminar. at 2.30 pm. The liability privileges of hosting providers (Art. 14 E-Commerce Directive 2000/31/EC, section 10 German Telemedia Act (TMG)) is given as the reason for this value gap. New business models in the digital world have led to significant changes in recent years. 20 years ago it was inconceivable that individual music tracks, albums or even an entire collection of albums could be listened to on a mobile phone. In contrast it is virtually taken for granted today that an unlimited amount of music or even video content can be enjoyed on a smartphone at any time and place. This has not only displaced existing services and business models, but has also led to new forms of exploitation and changes to the copyright value chain.

MIDEM 2016 – International Association of Entertainment Lawyer

Auch in diesem Jahr war die International Association of Entertainment Lawyers wieder wichtiger Bestandteil der Musikmesse MIDEM in Cannes. Topthema der IAEL-Seminare dieses Jahr: „The Monetization of the Global Music Business – from Creators to Major Industry“.

Mit dem gleichen Titel ist auch das Jahrbuch der IAEL 2016 erschienen. Neben zahlreichen anderen Autoren wurde von mir in dem Buch das Kapital „International Merchandising and Branding – Exploiting One’s Celebrity Status through Merchandising and Endorsement Agreements” bearbeitet.

In dem Beitrag geht es darum, dass neben klassischen Urheberrechtsverwertungen in der Musikwirtschaft sich der Merchandisingvertrag und der Testimonialvertrag mit bekannten Persönlichkeiten als eine eigenständige Verwertungsform entwickelt hat. Insbesondere in Künstlerverträgen ist es üblich geworden, dass auch die Übertragung der Merchandisingrechte und Einräumung von Werberechten Vertragsbestandteil werden.

Mit der Einräumung dieser Rechte ist auch ein enormes wirtschaftliches Potenzial für die Verwerter gegeben. In dem Beitrag werden  die wesentlichen Vertragsgrundlagen und die wirtschaftlichen Eckdaten beschrieben und sowohl Verwerter als auch Künstler in die Lage versetzt, bei Vertragsverhandlungen in diesen Bereichen Informationen über die wichtigsten Grundlagen zu haben.

Gleichzeitig war ich dieses Jahr neben David Given (USA), Jagdish Sagar (Indien) und Justin Goldspink (Großbritannien) Teilnehmer der Podiumsdiskussion zum Thema „What`s new – Unique Trends around the World“

The Streaming Revolution in the Entertainment Industry

Das Hauptthema der International Association of Entertainment Lawyers (www.IAEL.org) auf der Midem 2015 in Cannes war “The Streaming Revolution in the Entertainment Industry”. Die IAEL hat sich daher auch in ihrer jährlichen Publikation diesem Thema angenommen.

Unter der Überschrift „Streaming legal issues: Copyright in Germany“ habe ich in der Veröffentlichung einen sehr ausführlichen Bericht zu den aktuellen rechtlichen Entwicklungen in der Bundesrepublik Deutschland zum Thema Streaming gemacht. Das Angebot kostenfreier Nutzung von Film- und Musikwerken durch das Herunterladen dieser Werke im Internet hat sich in den vergangenen Jahren zunehmender Beliebtheit erfreut. Zahlreiche Filme und Musikaufnahmen sind ohne Einwilligung der Urheber oder Leistungsschutzberechtigten dort eingebracht worden. Dabei gab es zahlreiche rechtliche Auseinandersetzungen. Den Nutzern wurde vorgeworfen, unzulässig vervielfältigt zu haben. In meinem Beitrag stelle ich die technischen Hintergründe des Streamings sowie aktuelle Entscheidungen dar

Licensing of Music – from BC to AD

Auch in diesem Jahr hat die “International Association of Entertainment Lawyers“ auf der Musikmesse Midem in Cannes seine jährlich erscheinende Publikation zu den neusten Entwicklungen im Entertainmentbereich veröffentlicht.

Unter Federführung von Adrienn Karancsi und James Kendrick haben mehr als 30 internationale Autoren auf 400 Seiten sich mit den wichtigsten Fragen der Lizenzierung im Musikbereich im Zeitalter der Digitalisierung auseinandergesetzt. Ich freue mich sehr, dass ich auch in diesem Jahr zum Autorenteam gehören durfte und mein Beitrag „Performer‘s agreements with producer or venue: Special issues in Europe“ in dem Werk berücksichtigt wurde.
